Our Standard Contract

GENERATOR ORDER POLICY
This order is accepted by customer as written. There are no cancellations or refunds of generator and installation orders. Damaged or defective materials will be repaired or replaced according to the CG Standard Limited Warranty and all such disputes shall be handled in accordance with the Opportunity to Cure and Governing Law/Designation of Forum provision set forth in the Terms of Agreement on the reverse side of this page. I agree, and will not, dispute any payments made to CG via credit card, or issue stop payment on any check, regardless of the situation once material has been received by customer or delivered on installation date. Generators are ordered per the approved Order Form provided by the customer. Plans not provided by CG are sole responsibility of the customer. I understand that my final balance will be based on the completed installation and may change based on the final measurements and type of equipment installation. Customer will pay minimum 50% deposit to process order. Balance on order is to be paid in full prior to completed installation. If a Customer chooses to use a credit card for the final balance the payment must be made the day prior to the installation and a receipt will be provided at delivery. CG will not be liable for any damage to the existing premise if the customer is not present for the in-home installation. I hereby expressly agree that any amount due to Colonial Generators that is not paid in full within thirty (30) days from due date shall be turned over to a third party for collection. All fees, interest and costs (including attorney’s fees) incurred for collection shall be the sole responsibility of Customer. You, the buyer, may cancel this transaction at any time prior to midnight of the third business day after the date of this transaction.

TERMS OF AGREEMENT
These Terms of Agreement have been created by Colonial Generators (hereafter referred to as “CG”) to define our customer’s expectations for the installation of a stand by emergency power generation system in their home or business, as well as defining the proper course and method for any remedies sought. The customer needs to fully understand each point presented before as their signature constitutes approval to move forward with the order. This agreement is in accordance with the Home Improvement Consumer Protection Act. If you have any questions, please contact the Bureau of Consumer Protection at 1-888-520-6680.

ORDER AND INSTALLATION SETUP
I understand that it is my responsibility that certain specifications with regards to existing electrical box and natural gas or liquid propane must be met to install a standby emergency power generation system. CG will aid the homeowner in this process but it is my responsibility to contact the local natural gas or liquid propane service provider to confirm the meter and/or tanks are sufficient to handle the new equipment. If I am not ready for the scheduled and agreed upon in-home installation date and time and do not communicate this to CG resulting in a truck roll, I will be charged a trip charge of $200.00 and will be given the next open date and time. This will also result in the rescheduling of your installation date.I understand that permits for the installation of a standby emergency power generation system may include electrical and plumbing permits and are the responsibility of the homeowner. CG will provide assistance in preparing and filing documentation to obtaining permits from the appropriate municipalities however, the customer acknowledges that permits may be required for the installation. I understand a decision maker who is an adult over the age of 18 and who can make all decisions regarding the standby emergency power generation system must be on site for the duration of the installation. All correspondence prior to the estimate will be used only as guidelines and are not considered exact until the site has been reviewed by an agent of CG. Those decisions made at the site review will be binding and if a person is not on site that can make all decisions then I will be charged a trip charge of $200.00 and will be given the next open installation date and time. This will also result in the rescheduling of your installation date.

WARRANTY DISCLAIMER
I understand that each manufacturer of standby emergency power generators provides factory warranties and owner’s sole remedy are limited to repair or replacement. Refer to each specific manufacturer’s warranty guidelines. It is my sole responsibility as the owner to register the equipment with the manufacturer and maintain it according to the manufacturer’s specifications. CG will provide a 90 day parts and labor warranty for each installation. CG will perform all service and repairs covered under warranty provided that the homeowner contracts CG to provide maintenance for a period equal to or greater than the life of the warranty.

INSTALLATION
I understand that CG is responsible for the installation of a standby power generator system in my home or business which includes natural or liquid propane gas plumbing and electrical work. I further understand that it is my responsibility to obtain any necessary electrical and plumbing permits. If a permit is required for installation by my municipality it is understood that CG will not schedule or perform any installation prior to having the permits issued. I understand that the installation will cause incidental dust in the home which should be expected. I should cover any surfaces I want to protect and remove any objects near electrical boxes that I don’t want exposed to the installation process. I further understand that incidental damage may occur to my walls, ceiling, and landscaping and I agree to not hold CG liable for any such incidental damages which may occur during my installation. I understand that it may be necessary to drill a hole into my home’s foundation for the electrical and gas connections. I will not hold CG liable for unrelated damage to my foundation AFTER the system has been installed. If it becomes necessary to dig a trench for the electrical and fuel installation it is my responsibility to contact the local authority and have the site marked for utilities. If I am not ready for the scheduled and agreed upon in-home installation date and time and do not communicate this to CG resulting in a truck roll, I will be charged a trip charge of $200.00 and will be given the next open date and time. This will also result in the rescheduling of your installation date.

OPPORTUNITY TO CURE
Prior to instituting any formal claim for damages, I understand that I shall first provide CG with sixty (60) day notice of any alleged deficiencies in performance, and within that time CG shall have the opportunity to either cure or refute the alleged defect.

GOVERNING LAW/ DESIGNATION OF FORUM:
I understand and agree that the laws of the Commonwealth of Pennsylvania shall govern all matters arising out of or relating to this agreement, including, without limitation, its interpretation, construction, validity, performance and enforcement. Further, I understand and agree that a party bringing a legal action or proceeding against the other party must bring the legal action or proceeding in either the Magisterial District Court 38-1-09, 485 S. Henderson Rd, King of Prussia, PA 19406, or in the Court of Common Pleas, Montgomery County, PA, and that these courts, and its appellate courts, shall have exclusive jurisdiction for the purposes of all legal actions and proceedings arising out of or relating to this agreement.

ORDER POLICY
I understand cancellation of orders may be allowed provided that no order has been placed with the manufacturer or installation has occurred on the order and I am within my 72 hour right to rescind (cooling period). I further understand that after the 72 hour right to rescind (cooling period) I will be responsible for a 25% cancellation fee based on the contracted order total as represented on the front side of this agreement. If the in-home consultation has already occurred, then I will incur an additional charge of $200.00 (above the 25% cancellation fee) for the order. All applicable refunds will be processed within 7 – 10 business days of notifying CG of your intent to cancel your order. I understand that CG employees are not to remove their shoes or boots when working and that this is according to CG‘s insurance provider and cannot be deviated from. If there are any surfaces that I do not want Colonial Generators walking on, I must protect the surface with plywood or like sheeting. Plastic covering is too slippery and will be a tripping hazard.  I understand all installation times given are approximate and a window of 4 hours is allowed. Weekend, holiday, or after hours appointments are at the discretion of CG. I also understand that if I need to change an appointment date or time that I must contact CG directly at least one day (24 hours) in advance or I will be liable for a trip charge of $200.
